“The Court will now allocute Mr. Combs on his right to testify on his own behalf.”
Mr. Combs told Judge Sub
He was doing great.
Judge Subramanian, “How are you feeling today?”
Then asked the Judge how are you? Judge answered, good.
Mr Combs, “I want to tell you thank you. You’re doing an excellent job.”
Judge Subramanians:“OK. I appreciate that.”
Judge Subramanian: “In the last 48 hours, have you taken any drugs, medicine, pills or had any alcohol?”
Mr. Combs: “No, I have not.”
Judge: “Is your mind clear?”
Mr. Combs: “Yes, sir.”
Judge Subramanian: “Do you understand what is happening here In the courtroom?”
Mr. Combs: “Yes, sir.”
Judge Subramanian: “Do you understand that as a defendant in a criminal case, you have the right to testify on your own behalf if you wish to testify?”
Mr. Combs: “Yes, your Honor.”
Judge Subramanian: “Do you understand that you also have the right not to testify?”
Mr. Combs: “Yes, your Honor.”
Judge Subramanian: “Do you understand that if you decide not to testify, that no one, including the jury, could draw any inference or suggestion of your guilt from the fact that you did not testify?”
Mr. Combs: “I understand, your Honor.”
Judge Subramanian: “Do you understand that whether you testify or not is a decision for you to make, with the assistance of your lawyer’s, but ultimately that it is your decision to make and not your lawyer’s decision to make? Do you understand that?”
Mr. Combs: “Yes, your Honor.”
Judge Subramanian: “Now, without telling me what you May have discussed with your lawyers, whether you should or should not testify in this case?”
Mr. Combs: “Yes, thoroughly.”
Judge Subramanian: “Have you had enough time to talk with your lawyers and to think about whether to testify and the advantages and disadvantages of that decision?”
Mr. Combs: “Yes, we have discussed it.”
Judge Subramanian: “Is it your decision not to testify in this case?”
Mr. Combs: “That is my decision, your honor.”
Judge Subramanian: “Is that your decision not it could be–”
Mr. Combs interrupts: “That is solely– That is solely my decision.”
Judge Subramanian: Solely your decision. OK. Is there any further questions—”
Mr. Combs: “ I mean it’s my decision, but with my lawyers.”
Judge Subramanian: All right. Just to clarify, do you understand that it is your decision to make?”
Mr. Combs: Yes, my decision to make. I’m making the decision.
Judge Subramanian: And you’ve made the decision freely And voluntarily on your own behalf?”
Mr. Combs: Yes, your Honor.
Judge Subramanian: All right.
Rule 29 Arguments for Acquittal
Ms. Shapiro, for the defense presented the court with Rule 29 Arguments for acquittal.
The Government has failed to meet its burden to prove each element of Counts One through Five, and no reasonable jury could find him guilty if any of the counts beyond a reasonable doubt.
Ms. Shapiro noted several case laws throughout Rule 29.
Ms. Shapiro stated Mr. Combs is entitled to a judgement of acquittal on Count One because the Government has failed to prove the elements of the racketeering conspiracy charged in the indictment.
To engage in a RICO conspiracy, the government must prove that the defendant agreed with others to further an endeavor, which, if completed, would satisfy all the elements of a substantive RICO offense.
And, thus, what that means is that the government has to prove that in the words of the statute, Mr. Combs agreed to conduct or participate, directly or indirectly, in the conduct of an enterprise’s affairs through a pattern of racketeering activity.
The government failed to prove at least three of the elements of the offense.
First, the agreement to violate RICO.
Second, that the defendant knowingly and willfully joined any such agreement.
Three, that he agreed that he or another member of the alleged conspiracy would commit two racketeering acts.
Ms. Shapiro spoke about the Government having KK on their chart as a co-conspirator. She explained that there was evidence from Jane and Mr. Combs text messages, “that he could not have KK find out about the “Hotel Night.”
Messages from KK telling Mr. Combs he cannot keep secrets again. They will be in the same situation they are in now. Cassie’s lawsuit.
Ms. Shapiro gave the same reasons of the Government’s failure to prove guilt on Counts Two through Five.
