Bryana Bongalon
Ms. Bongalon testified that one night she awoke to Sean “Diddy” Combs banging on Cassie’s apartment door. When he got inside, Cassie emerged from her room and a knife was thrown in her direction from where Combs stood. Cassie picked up the knife and threw it back, but it did not hit him.
The first time Ms. Bongalon saw Cassie injured was on a FaceTime call before the premiere of The Perfect Match, where Cassie had a black eye. Bongalon remained quiet and expressed sympathy. She saw additional bruises on Cassie at random times afterward.
At Cassie’s 29th birthday party, Bongalon observed Combs and Cassie initially getting along before arguing. Cassie, upset, left the party with help from Deonte, who assisted her in packing.
Bongalon said she was subpoenaed to testify and was promised she wouldn’t face charges if she told the truth. She described Combs providing ecstasy, cocaine, ketamine, and “G” (believed to be GHB). She also witnessed Combs using marijuana, cocaine, and ketamine weekly, noting drug use intensified when he and Cassie were together. Bongalon admitted she obtained oxycodone, cocaine, and ketamine for Cassie. She said repeated attempts to stop using drugs failed due to the environment.
During a Malibu photo shoot, Combs approached Bongalon closely and said, “I am the devil and I could kill you,” leaving her shaken. She wasn’t sure if Combs was high at the time but admitted she might have been using drugs herself that day.
In September 2016, Bongalon stayed at Cassie’s apartment. Early one morning, loud banging woke her. Knowing it was Combs, she hid her ex-girlfriend in the bathroom before trying to act casual on the balcony.
Combs came up behind her, lifted her by the armpits, and placed her feet on the balcony railing, yelling, “You know what the f*** you did!” She feared falling but denied wrongdoing.
Ms. Bongalon heard Cassie say in disbelief, “Did you just hang her over the balcony?”
Combs then threw Bongalon onto balcony furniture. Later, Bongalon found a large bruise with a puncture wound on her leg. She sought medical treatment but did not reveal the cause, leaving her with back bruises, neck pain, and emotional distress.
Cross-Examination by Ms. Westmoreland
Ms. Bongalon had to explain why her new attorneys have the same accusations from her previous civil lawsuit. She didn’t know why.
Ms. Westmoreland wanted Ms. Bongalon to clarify some dates and drug usage information. She couldn’t remember. Some of the question had to rephrase or repeated for Ms. Bongalon. She didn’t know why she didn’t stay away from Mr. Combs after he threatened her. She only knew that Cassie is one of closest friends.
Ms. Bongalon said she wasn’t sure of the exact day in the end of September 2016 the incident with Mr. Combs happened. Since her camera data was September 26, that is the date Ms. Westmoreland focused on.
Mr. Combs and Ms. Ventura were both in New York. All types of receipts from the hotel and other businesses were submitted into evidence.
Redirect
The prosecution submitted a text message from Cassie to Kristina Khorram. The text was dated Sept. 30. and it was about the railing incident with Mr. Combs and Ms. Bongalon. That is the correct date.
On the side bar it was brought to the Judge’s attention by Ms. Westmoreland that the text was what Cassie was told. Not from her seeing the incident.
Enrique Santos
Expert Testifies on Cell Phone Meta-Data
Mr. Santos, a forensic analyst with 17 years of experience at the U.S. Attorney’s Office for the Southern District of New York, testified that he has performed approximately 3,000 cell phone extractions.
He analyzed three cell phones belonging to Cassandra Ventura. One of the devices had a changed IMEI number, indicating it had been repaired.
During direct examination, the prosecutor asked Santos to explain metadata associated with screenshots found on the phones. Santos testified, “The metadata is the creation date, modified date, and the storage location of the file.”
On cross-examination, the defense attorney asked if some deleted data can remain on a device. Santos confirmed, “Yes.”
The defense then questioned him about the date of a specific screenshot, asking, “September 30 is the capture date of the screenshot, correct?” Santos responded, “Yes.”
Mr. Santos was then excused from the stand.
