Before the jury entered. Prosecution stated, “Given that the defense were able to show Mia’s Birthday video for Mr. Combs, we have Mr. Combs phone call recordings from jail. We want to submit as evidence of organizing on social media for his children to video and post their birthday call to be used as a way to change the narrative.”

Former Hotel Security Guard Eddie Garcia Testifies

Eddie Garcia, a former security guard at the InterContinental Hotel, took the stand after being granted immunity on June 2.

Direct Examination

Garcia, who was 24 years old at the time and earning $10.50 an hour, testified that when he arrived at work, he reviewed surveillance footage. It showed Sean Combs physically assaulting Ms. Ventura earlier that day by the elevators.

Shortly afterward, Garcia began receiving phone calls at the security office from Khristina Khorram. She identified herself as Combs’ personal assistant. Khorram asked Garcia if he had the video and requested a copy. Garcia told her she would need to speak with hotel management.

Later that day, Garcia was called to the lobby, where Khorram was waiting. He again informed her she would need to talk to management or obtain a subpoena. Garcia admitted off the record that “the video was bad.”

Garcia then received a call from a New York number. He testified that Khorram handed the phone to another person, who asked, “Do you know who I am?” Garcia replied, “Yes.” The voice identified himself as Mr. Combs, who admitted he had been intoxicated and requested the video. Garcia responded that he couldn’t provide it.

Garcia emailed his management, but soon Khorram began calling his personal phone, making him nervous. During another call, Khorram handed the phone to Combs, who told Garcia he was “a good guy” and that something like this could “ruin him,” insisting he needed the video to protect his career. 

Combs implied Garcia could help make the situation go away and said he would “take care of him.”

Garcia reported the calls to his supervisor, Bill Medrano, who suggested they could sell the video for $50,000 and erase it from the hotel’s system.

Garcia called Khorram again and was connected to Combs, who addressed him as “Eddie, my angel,” and told him, “I knew you could do it. Let’s do it right away.”

Garcia then told Medrano, who entered the server room and returned with a black USB drive containing the video, saying, “Done.”

Garcia arranged to meet Combs in West L.A. at a high-rise building. When he arrived, he encountered a bodyguard, Khorram, and Combs himself. Nervous and with his voice cracking, Garcia handed over the USB. Combs asked whether it was the only copy; Garcia said he believed it was. 

Combs emphasized that there could be nothing stored in the cloud, and after Garcia confirmed with Medrano, he assured Combs it was the only copy.

Combs then FaceTimed Ms. Ventura, who appeared wearing a hoodie, and she expressed her concern that the video’s release would damage her reputation before her upcoming movie.

Combs requested Garcia’s ID, as well as identification for Medrano and another officer they had used in place of the initial responder. Combs then presented Garcia with a non-disclosure agreement (NDA) on his company’s letterhead, which included a liquidated damage clause of one million dollars. Garcia signed the NDA, which Combs then took back.

Garcia testified that he was given $100,000 in a brown paper bag. Combs escorted him out and warned him not to make any big purchases. The money was divided: $50,000 for Medrano, $20,000 for a man identified as Elias, and $30,000 for Garcia himself. Garcia used his share to purchase a used car with cash.

Cross-examination

Mr. Garcia told the defense attorney that he wanted nothing to do with this. When he was contacted, he acted like he didn’t know anything. When he knew there wasn’t any other way he got an attorney and came in. He didn’t change his story at all.
